LANDWASH BREWERY QUEST FOR THE CREST
OFFICIAL RULES AND REGULATIONS
1. Overview – 24 Coasters will be produced and will be placed in 24 randomly selected cases of Cold Lager (12 pk). Each of the 24 Coasters will entitle the holder to a FREE case of Landwash Beer (24 pk).
No cash equivalent and no substitutions will be made except as provided herein at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.
2. Eligibility – This promotion is open to persons who are at least nineteen (19) years of age at the time of claiming their prize.
3. Sponsor – Landwash Brewery, 181 Commonwealth Avenue, Mount Pearl, NL A1N 4L3.
4. Timing - Holders of the winning Coasters have until 12 midnight on September 18, 2024, (the “Expiry Date”), to present the winning Coaster to the retail store located at 181 Commonwealth Avenue to claim their prize. Should a winning Coaster not be presented to the retail store location on or before the Expiry Date for any reason whatsoever, the Prize shall be null and void.
5. Release – By receipt of any prize the winner agrees to release and hold harmless the Sponsor, and their respective subsidiaries, affiliates, suppliers, distributers, advertising/promotion agencies, parent companies, and all company’s officers, directors, employees and agents (the “Released Parties”) from and against any claim or cause of action including but not limited to personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.
6. Publicity – the Sponsor has the option to publish, except where prohibited, the name, photograph, voice, opinions, hometown and province of any winner for promotional purposes in any media, worldwide, without further payment or consideration for the Sponsor’s legitimate business interests.
7. General Conditions – The Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, or human error impairs the integrity or proper functioning of the Promotion as determined by the Sponsor in its sole discretion. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the Coasters or to be acting in violation of the Official Rules and Regulations or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the contest may be in violation of criminal law and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extend permitted by law. The Sponsor’s failure to enforce any term of these Official Rules and Regulations shall not constitute a waiver of that provision.
8. Limitations of Liability – The Released Parties are not responsible for (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programing associated or utilized in the Contest; (2) unauthorized human intervention in any part of the entry process or the Contest; (3) technical or human error which may occur in the administration of the Contest; (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the Contest, or receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules and Regulations to be available and/or claimed, the Sponsor reserves the right to aware only the stated number of prizes.
9. Disputes – Except where prohibited, the winner agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by Courts of Newfoundland and Labrador; (2) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, but in no event attorney’s fees; and (3) under no circumstances will the winner be permitted to obtain awards for, and the winner waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
10. Legal – All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and Regulations, or the rights and obligations of the Winner and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the Province of Newfoundland and Labrador.
